HQCJ Admits the UBA to the Assembly Forming the PIC Third Composition

Background#

On 27 July 2023 the High Qualification Commission of Judges of Ukraine adopted decision No. 40/zp-23, determining which civic associations met the statutory requirements for participation in the assembly of representatives that forms the Public Integrity Council. Sixteen organizations were recognized as meeting the requirements and five were refused.

The Ukrainian Bar Association, registration code 26334715, was among those admitted. On 14 August 2023 the PIC’s third composition took office, with Oleh Yakymiak and Nazar Martyniuk serving as UBA delegates.

Why the Date Matters#

By July 2023 the Indicators of Integrity had been in force for four and a half years in their original version and two and a half years in the revised version containing paragraph 1.5. The PIC had by then issued negative integrity conclusions against judges over connections to occupied Crimea — travel, property predating the occupation, resident family members.

The application to participate in forming the Council was therefore made with full public knowledge of the methodology in force and of how it was being applied.

This instance rests on a published act of a state body identifying the organization by its registration code, not on association or inference. The UBA applied of its own initiative, was vetted, and was admitted.

The organization took part in the assembly but placed no member among the 23 recorded in the third composition. The decision was taken two years and seven months after the Council unanimously adopted the revised Indicators of Integrity on 16 December 2020. The organization returned for the following cycle and was admitted again in 2025.
